    Suppose that Blue Cross or Kaiser ask Gilead Sciences (Ireland) for a price for Sofosbuvir?

    Gilead Sciences (Ireland) will give a polite answer: “we can supply for price X + Import Tariff (where X = about $50,000 after discount on our regular List Price, and USA Import Tariff is usually Zero for most pharmaceutical products, but it might rise if the New President changes it).”

    Gilead Sciences (Ireland) will then kindly propose: “If you are importing to the USA, it would be faster and easier for you if you contact our US distributor, who will offer you a price of X (same X as above) with no delays and no Tariff.”

    Bottom Line:

    Even if the new US Administration increases Import Tariffs on Medications, Gilead will still have it all Stitched Up because Gilead Ireland UC is a subsidiary of Gilead Inc., and Gilead Inc still hold a world patent (almost) on Sofosbuvir.

    Hi Hieupham,

    The link you gave about UK tax is for UK businesses. Individuals generally cannot reclaim VAT.

    In the UK, some medical services are exempt from VAT:

    (see section 3.2)

    But generally, this only applies to certain prescription medicines obtained from a (UK) registered doctor, dentist or pharmacist.

    Hi Mic52,

    Yes, this is normal. In the UK, you have to pay VAT on everything you buy. Usually this is handled by the seller, so the price you see in the shop is what you pay, but it already includes the VAT. Same thing for anything you buy from within the European Union – the seller will have already paid the VAT. And thanks to being a member of the EU (maybe not for much longer after Brexit), you don’t have to pay VAT on anything you buy from europe because the VAT is already paid by the seller.

    But for importation to UK from outside of the EU, the UK customs assume that no tax has been paid by the seller. And since UK customs often don’t really know the pre-tax value of the product, they usually charge VAT on the value declared by the shipper. But if the declared value is less than £15, then UK customs will not charge VAT on it.

    To be completely honest, and for insurance purposes, it is always wise to ask the shipper to write the correct value on the shipment.

    But if I was buying something that the NHS could not afford to provide after all the National Insurance contributions that I have paid over 30 years or more, I wouldn’t much care about insurance or VAT :whistle:

    [little ps. for any HepC victims in the UK who voted for Brexit: I hope you realise that you will soon probably have to pay VAT on all that nice French wine that you will soon be able to drink after you have cured yourself with imported generics :P ]

    Hey Fitz,

    Turing Pharmaceuticals bought the marketing rights to Daraprim from Impax in 2015, and then promptly jacked the price from $13.50 to $750 per pill. This can only be described as a scandal. Since it happened in the USA, it seems fair enough to call it a “USA price hike scandal”.

    The price of an epipen in the USA ($600 for two shots from Mylan, also an american company) is also a scandal. In the UK it costs about $69. In France the cost is about $100.

    And then of course there is sofosbuvir from the american company called Gilead, with a discounted USA price of anywhere upwards of $40,000 per 3-month treatment. Since the raw materials now cost only about $100, this is also a scandal.

    But is it “america bashing” to get angry about these injustices? I don’t think so. There are some great americans on this site, like Mike and yourself, and I’m sure many of the rest of us appreciate your input. Me, I’m going to carry on throwing my little rocks against greed and injustice whenever I can.

    Anyway, in deference to your objection, I modified my previous post to name Turing Pharmaceuticals as the guilty party in that example.

    Thank you for moving my post to a separate thread. But I have to say, I fundamentally disagree with any model of fixing the price of medical treatment according to the ability to pay (GDP or average income). This is exactly what Gilead are doing, and by taking it to its extreme they are literally getting away with murder.

    Sure, prices should be “fixed downwards” according to ability to pay in poor countries, but not “fixed upwards” according to ability to pay in rich countries.

    So just for fun (or maybe not), here is some simple number crunching based on Gilead’s sales figures and the definition of profit margins…

    In most businesses, it is quite reasonable for a company to have a profit margin of from 5 to 10%. For supermarkets, it is typically 5% or less. For specialist engineering it is around 10%. For banks, it is about 18%

    Well, everyone knows that the banks rip every one off – left, right and centre… But let’s not get into that ;)

    My target here is Gilead. Their profit margin is reported to be a whopping 45%

    So what is profit margin anyway? It is the ratio of net income (gross income after deduction of expenses) over gross income.

    So if Gilead are charging $40 000 per treatment (after government or health-insurance negotiated discounts on the famous $1000 per pill “list price”;) for something that in reality costs less than $1000 to make, why is their profit margin “only” 45% and not more like 4000% ???

    We can only suppose it is because they are either COOKING THE BOOKS or they have MASSIVE expenses (or both). But since Gilead is operating legally within US and international law, and apart from a few tax dodges like operating out of Ireland, they cannot be cooking the books… Right?

    But hang on, Gilead paid $7 billion to Pharmasset to get the patent for sofosbuvir, didn’t they? Sure, that is a MASSIVE expense. Obviously, they have to make that back, and some, in order to make a decent profit? Right! But Gilead reported $18 billion Harvoni sales in 2014 in the USA alone plus $5 billion in europe alone. In 2015, it reported $21 billion (USA alone) and $7 billion for europe:

    So just for a quick estimate, and ignoring 2016, in these two years we are looking at Gilead profit margin = (18+5+21+7-7-X))/(18+5+21+7), where X = all other expenses. So if you do the math to find X with profit margin = 45%, you get 44-X = 51*0.45, or X = $21 billion for “other expenses”.

    OK, this is probably not very fair to Gilead. Lets Say Gilead spend $1 billion on Clinical Trials and $1 billion on staff salaries during the period. These are fair expenses? So now we get 44-2-X = 51*0.5, or roughly X = 42-51*0.45 = $19 BILLION for “other expenses”. In other words,

    IN 2014 and 2015, GILEAD MUST HAVE SPENT SOMETHING IN THE REGION OF $19 BILLION USD TO CARRY OUT ITS BUSINESS OF SELLING SOFOSBUVIR IN THE USA AND EUROPE.

    Just think about that for a minute…?

    So where did all this money go? If we believe the published sales figures and profit margin, and because compared to such big numbers, the COST OF PRODUCTION IS ALMOST NEGLIGIBLE, this must mean that

    IN 2014 and 2015 GILEAD PROBABLY SPENT IN THE REGION OF $19 BILLION IN LEGAL, LOBBYING MARKETING, and “OTHER” COSTS.

    Well, I’m not an accountant and this is just simple math. Probably I am out by a few billion.

    But unless my simple math is completely wrong, surely this means something is fundamentally wrong with the pharmaceutical business?

    “Following a two days-public hearing at the EPO headquarter in Munich, Germany, Gilead Sciences arguments to uphold its patent on Sofosbuvir have not been totally accepted by EPO opposition division. The EPO has decided that Gilead’s patent extended beyond the content of the patent application as filed. Technically, the EPO’s decision means that sofosbuvir in itself is not protected by a patent any more….”

    Wow! sofosbuvir in itself is no longer protected??? That’s the key!!!

    But then it goes on:

    “The Court has explained that the patent was not so strong at it was supposed to be. This shows that the quality of the patent was weak, and that public intervention in the patent system matters. But in maintaining the patent – even partially – this decision is not enough to reverse the balance of power toward the benefit of the health of population and the financial equilibrium of health insurance systems.”

    So where are we exactly?

    Does anyone know what’s going on? There has been almost no press coverage so far….

    It’s always interesting to look at the language used in these reports, isn’t it? To quote from this article (and not necessarily the people actually being quoted)…

    “As a result, a generic version of Sovaldi — the first of the new crop of hepatitis C medications to revolutionize treatment — could become available in Europe in 2024 instead of 2028, according to Tahir Amin, the who heads intellectual property at IMAK, the Initiative for Medicines, Access & Knowledge, a nonprofit that works with patient advocacy groups in challenging patents.”

    “A Gilead spokesman sent us a statement maintaining the patent, as a whole, was not revoked. “The European Patent Office “confirmed that Sovaldi was covered by a valid European patent,” he wrote us. The patent office “found that claims covering [Sovaldi] within the patent were valid. The board believed that these claims were novel and inventive.” He also insisted there will be no impact on the possibility of generics arriving before 2028.”

    Hmmm, … lets just pick out two key phrases: “could become available in Europe in 2024 instead of 2028” … and “no impact on the possibility of generics arriving before 2028”

    While technically this analysis might be be correct, to properly report on the real situation it should be qualified (but isn’t) with the words “through corporate sources.”

    So the corporate propaganda (that they control the market) continues as usual, and as usual ignores the fact that equivalent generic medications are available now through personal importation provisions in the USA and many european countries….

    Started Sof+Dac from fixHepC 10-Nov-2015. NO sides.
    Pre-Tx: AST 82, ALT 133, Viral Load 1 900 000.
    Week4: AST 47, ALT 58. VL < 15 (unquantifiable). Week12 (EOT): AST 30, ALT 26, VL UND Week16 (EOT+4): AST 32, ALT 28, GGT 24, VL UND Week28 (EOT+16): AST 26, ALT 22, GGT 24, VL UND Ever grateful to Dr James. Relapsed somewhere after all that... Bummer! Jan 2018: VL 63 000 (still GT3).
